Terms and Conditions

2.   Ordering goods

Ordering goods

List of products on the website www.lucistnice.cz is a catalog of commercially available products. Supplier does not guarantee the immediate availability of all items. Availability will always be confirmed on request.


To order the customer selects goods , completes order form and sends the order. Sent order is a proposal to conclude a purchase contract. The order also serves to reserve goods.


Customer can check the prices of goods with individual items. Prices of goods are valid at the time of placing the order .


Referring bows and crossbows for adults (i.e. with a draw weight greater than 15 kg/33 lbs), it is possible to deliver the goods only to persons older than 18 years of legal capacity. By placing an order the customer agrees with the Terms of use.


Cancellation of the order


Customer and supplier may without giving any reason, cancel the order untill the time the order is confirmed by the supplier. If the supplier cancels the order, he provides a reason why the ordered was cancelled. Cancellation of orders by the time of the purchase agreement is possible only after prior agreement of the supplier and the customer, and the conditions that are mutually agreed.

 

3.   Shipping and Delivery

Delivery time

During the summer holidays (July and August), we are shooting at seasonal shooting ranges. Therefore the goods are usually shipped once a week (on Monday).

Goods will be delivered as soon as possible by mail. Goods labeled "in stock" are usually devered in 2-7 working days. Goods labeled "On request" are delivered once they are made, we will inform you about the estimated time of sending. Goods paid by money transfer can be shipped only after receiving your payment.

The method and cost of transport, packaging

Transportation is provided by the supplier via Czech Post The cost of shipping goods varies according to the size and quantity of the goods.

Postage is divided into several categories.

 

Small objects (points, string ...)

50 CZK

Small items (arrows...)

100 CZK 

Large objects (arrows, targets, bows up to 150cm, ...)

150 CZK

Targets (stands, shootproof layers)

100 CZK / 1 pcs

 

Each target must be packaged as a separate package with its own postage fee. For other goods, postage is not loaded with every piece.

The shipping and handling will be calculated in the second step of the order and the customer will be asked to confirm the total amount.

If you pay "cash on delivery" we charge for this service extra 30 CZK.

When buying over 10.000 CZK postage is free.

We package the goods with the environment in mind. Because of the use of simple materials and waste we also do not charge handling. Individual components of package material can be separated and sorted. Thank you for helping us protect the environment.

 

Method of payment of the price for goods

We accept PayPal.

It is possible to agree on money transfer.

Shipment of goods always includes a tax receipt. We are not VAT payers.

 

Acceptance of goods

We recommend to inspect the goods immediately after receiving. If the mechanical damage of packaging is found, write in the presence of a carrier the form about damaged shipment and let this fact be confirmed by the carrier.

Based on the record , carried out by the customer we will give a reasonable discount or ship a new product. The customer also has the right to cancel the contract.

By signing the waybill to the carrier the customer agrees to take the goods and confirms that it arrived mechanically undamaged. Therefore, rather carefully check the packaging before signing.

Communication between the customer and supplier

Communication between supplier and customer is ongoing by electronic mail, unless the parties agree otherwise.

 

4. Warranty terms and Complaints - The responsibility for defects

Guarantee of exchange

We deal all warranty claims, where the defect becomes apparent within 30 days of receipt of goods, with the exchange of goods for a new one. If the item is not in stock at the moment, it wil be ordered for you in the shortest possible time or we will allow the selection of other goods of the same value. For accelerated resolving the claim in exchange for a new one within 30 days of purchase must be claimed goods returned complete. No replacement shall apply to mechanical damage.

The warranty period


The warranty period begins on acceptance of goods by the customer. Warranty does not cover normal wear and tear goods (or their parts) caused by use. Shorter product life in such a case can not be considered a fault and it can not be claimed.

Complaint


In the event that a customer appeared on purchased goods during the warranty period, a defect that was not caused by improper use, but a defect in the product itself is under warranty, the right to claim the goods.

 

How to claim


If a customer wants to claim the goods purchased in the online store lučištnice.cz, he/she should contact customer service and give particular type of product and a description of the fault. We will information on how to proceed.


It is advisable to send the goods in original packaging or good transport packaging, because the supplier does not guarantee any mechanical damage before accepting the goods. In case of a justified complaint, the customer is entitled to compensation in the amount of postage necessary expenses for safe delivery (must have proof of this transportation). In the case of unjustified complaints customer has to pay its own costs associated with the settlement of claims and at the same time or supplier is not entitled to reimbursement of costs incurred on its side (if this is not a replied claim without a reason - so it would be misuse of consumer rights).

Dealing with claims


The Contractor shall consider the complaint defects of the goods and the assessment shall inform the customer by phone or email of the outcome of the complaint. Subsequently, the customer will be asked to pick up the goods claimed .
The deadline for settling a claim pursuant to the Act No. 634/1992 Coll is 30 days.

 

Withdrawal from the contract

The customer's right of withdrawal

The customer is entitled to withdraw from the contract if the contractor fails to comply with the agreed terms of delivery.
A customer who buys goods in a commercial or other business activity, has also in accordance with § 53, paragraph 7 and § 54 of the Civil Code, the right to withdraw from the contract within 14 days of receipt of goods.

The Contractor's resignation


The supplier is entitled to withdraw from the contract only until the dispatch of the goods, just in case the goods or significant changes in the prices of goods. Before withdrawing the supplier is always obliged to contact the customer to agree on how to proceed.


Procedure in case of withdrawal:
Due to the fact that in case of withdrawal from the contract is canceled early, the supplier returns or replaces to the customer everything received.
The customer can withdraw from the contract by notifying electronically to the email address info@lucistnice.cz .
Upon withdrawal we recommend to submit an original or copy of proof of purchase. Any items where it is not clear why it was was sent to us, will be returned to sender.
If the customer received and accepted  the goods, he/she shall send the goods back to the supplier, the supplier immediately examines the condition of the returned goods. To return the full amount of the money the goods must be sent back to the supplier undamaged, complete ( including accessories and all documents).
In case that the goods are returned to suppliers in other than original shape, the customer is obliged to compensate the particular costs associated with placing the goods in original condition and the damage caused to the goods. The refunded price will be reduced appropriately.

The contradiction of the purchase contract
In case that accepted item is not in conformity with the contract ("conflict with the contract") we proceed in accordance with § 616 of the Civil Code.

6. Customer Privacy

The supplier collects the consent of customers personal data of customers:  name, address, phone and email. These data are used primarily to facilitate customer orders in the future. The supplier does not provide personal customer data to others.

7. Final provisions


These terms and conditions apply to all contracts concluded between a supplier and a customer.
The supplier reserves the right to change the terms and conditions. The changed conditions will be appropriately published on the website www.lucistnice.cz.
